Important Information Abut Some Aspects of Mexican Law

Good Morning Dear Friends
         Today I will discuss a few items regarding the Mexican legal system;you should find them interesting.
         To begin there are no trials by jury in Mexico;when you are bought before the district attorney,a judge or a higher official of the judicial system that person and that person only decides your fate.There is an appeal system in place but it is terribly lengthy and very costly.I always have and always will very seriously advise all foreigners to obey all Mexican laws because of the harsh penalties involved and the horrid,sometimes inhumane living conditions within the penal system.
         All contracts,bills of sale,receipts etc.Must be in Spanish;if not they are invalid.All Receipts should be kept in a safe place regarding all items in your home,vehicle or on your vessel.In Mexico they prove that you did not acquire these items illegally.If items are stolen from you and you make a formal complaint you will be asked to show the corresponding receipts.If you cannot show a valid receipt the government in all probability will refuse to take any action what-so-ever.
        Do not work in Mexico without the permission of the Mexican Government.It is dangerous,All that you own may be confiscated and you may be institutionalized.If you care to work in Mexico I suggest you first make an appointment with an Mexican Immigration Official and discuss your intentions.Keep in mind that Mexico is looking for investors who will create work positions for their so many unemployed citizens.Don't come here to illegally take money away from the Mexicans people;come here to help this beautiful country.Remember if you work without government permission and you are detected you will be at the mercy of many governmental agencies including Mexico's I.R.S. (Federal Hacienda) who will take away from you everything you own.If you smuggle items into Mexico that is a Federal offense;if detected you will go to a Federal Prison.
       No foreigner may own property in Mexico;past experiences have taught Mexico numerous lessons.I refer you to the Manifest Destiny and the takeover of the Mexican Petroleum Industry.I repeat,no foreigner may own property in Mexico.The foreigner who wants to rent,lease,or contract a home or property may do so with an agreement with a government controlled Mexican banking institution.Be advised that most of the property in Mexico cannot be owned by any Mexican and most certainly no foreigner as these properties are Federal.The laws regarding property are very complex;if you need information write me I will help you without a fee.Many unsuspecting people spend great sums of money and then find they are the victims of an unlawful purchase.Several years ago an American lost $300,000 dollars on a property purchase in our municipality.
       Do not use what is called "borrowing a name".In Spanish it is called "Presta Nombre";this occurs when a foreigner pays for and puts a Mexican property in a Mexican's name.This is seen by the Mexican Government as illegal and is an attempt to violate a serious Mexican law.If you ask the United States State Department how many times the foreigner looses his money and the property using a Mexican's name they will tell you "100% of the time". What eventually occurs is the legal title holder thinks the matter over and tells the foreigner "I want this property for myself and my family....you don't have any legal standing in this matter.Vacate my property or I will call the authorities."
     Many times people have come to me asking for assistance regarding  serious legal problems;I give them  some personal advice and usually refer them to the proper agency.In very serious matters I refer them to their Embassies and Consulates who will suggest to them the names of local attorneys who possibly could be found to be trustworthy.Foreign attorneys cannot practise law in Mexico.
